Felix Frankfurter Case Study: The Client: A Multinational Corporation that was a victim of theft and an organized scheme to defraud September / 2016 Client's customer purchased very substantial amounts of equipment from client over a series of years. They were supposed to pay client through lockbox agreements. Instead of paying for the equipment, customer provided excuses to client for payment delays. The Problem: The customer no longer had the equipment or the money to pay back the client for the goods purchased. They gave the equipment away for free to high profile clients of theirs in exchange for benefits such as box seats to major sporting events to promote their business. Any money they made from selling other equipment they obtained from the client was siphoned out of their business to pay for the owner's Armani suits and other personal expenses. The Solution: We filed a lawsuit in federal court in Florida alleging that the customer breached their contract with the client, committed civil theft, and committed an organized scheme to defraud the client. The Outcome: After obtaining discovery in the case, we were able to prove that client's customer misappropriated funds intentionally. After obtaining the admissions of guilt, we mediated the case and settled in lieu of having to go to trial. Client was paid back and spared the expense of having to pay for trial.
