Your Civil Rights In
Your Own Home
A young, ambitious, wealthy and full of life twenty something
dot com Millionaire has purchased a home on the Florida
Intercostal. The centric reasoning for the purchase was to have
a mooring dock for his new yacht. However, he would also use the
home, not his primary residence, to have friends stay or to
party. Although generally liked by the neighbors, there were
incidences where the parties became annoying. However, the young
man would always and graciously accommodate his neighbors wishes
for quiet enjoyment of their own homes. There was and is no
evidence any of his neighbors found him harassing or
intimidating. One night, there was a ringing at the doorbell
whereupon many of his Civil Rights were abused and the security
of his home was penetrated, by the Local Police.
The Circumstances and the Event
The Boca Raton Police assert they were called to the
Defendant residence for complaints of noise. Although logs show
no such call against the timeline, there was evidence that the
Police had the Defendant under surveillance. Previously, Police
had arrived at his home under complaints by a person who lived
several house away from Defendant.
The Arrest
Upon arriving at the Defendant’s Front Door, there was an
exchange, all caught on Security Camera Tapes. Ultimately, the
Police reached into the home and dragged the Defendant from his
home and onto the Front Porch. The Police, with no cause, slam
him against the wall, physically subdue him and cuff him.
The Processing
The police arrested the Defendant for Resisting Arrest
Defense Position
The Police (as shown on Security Tapes) had no Probable Cause,
no Warrants or any provocation that would allow them to come
into the Defendant’s home and extract him physically.
Present Circumstances
The Boca Raton Prosecutor has since dropped the charges for
Resisting Arrest, but the City of Boca continues to pursue the
Noise Violation. The Mayersohn Law Group continues in process to
get all charges dropped and a Civil Suit is being contemplated.
Defendant has since sold the home and moved to Delray Beach,
claiming further harassment by Police as the prime reason. The
remaining case has been continued twice to date.
