In a recent case, I defended the rights
of an individual who was being stalked in Cyberspace, by a
pathological predator. While the events were every bit as
dangerous and palpable as a physical world stalker, this
woman, a working professional and a mother of three (3)
children was reduced into a crouching fearful knot of
nerves, afraid to answer her phone or walk her dog in front
of her own home.
A young, ambitious, wealthy and full of
life twenty something dot com Millionaire has purchased a
home on the Florida Intracoastal. The centric reasoning for
the purchase was to have a mooring dock for his new yacht.
However, he would also use the home, not his primary
residence, to have friends stay or to party. Although
generally liked by the neighbors, there were incidences
where the parties became annoying. However, the young man
would always and graciously accommodate his neighbors wishes
for quiet enjoyment of their own homes. There was and is no
evidence any of his neighbors found him harassing or
intimidating. One night, there was a ringing at the doorbell
whereupon many of his Civil Rights were abused and the
security of his home was penetrated, by the Local Police.
Is it a dismissible infraction to be
driving on the shoulder of a road with a flat tire? Is it
legal to have multiple prescribed drugs mixed into one vial?
The facts below reflect a situation that led to a search and
discovery of prescription drugs being incorrectly carried,
leading to an arrest, custody, forfeiture and a night in
jail. A 64 year old woman is forced to endure this and
retain a lawyer in a terrible situation simply because she
has not stored and carried her medication properly. The
circumstances this defendant finds herself in include
personal oversights that literally thousands in her age
group innocently commit or exposed to every day in South
Florida. Those circumstances, of her mislabeled and
inappropriate storage of medication(s) contributed to the
situation explained below.
